The Office of the Election Commission of Thailand (OECT) wishes to publicise the resolution of the Election Commission adopted at its 51st meeting in 2026, held on Thursday, 4 June 2026, concerning the consideration of criminal proceedings against candidates for election as Members of the House of Representatives under the party-list system, pursuant to Section 151 of the Organic Act on the Election of Members of the House of Representatives, B.E. 2561 (2018), and its amendment.

          The Election Commission resolved to initiate criminal proceedings against 28 candidates for election as Members of the House of Representatives under the party-list system. None of the 28 individuals is currently a Member of the House of Representatives. The candidates are alleged to have committed an offence by knowing that they were not eligible for candidacy in an election, due to lacking the qualifications or possessing any prohibited characteristics that render a person ineligible to exercise the right to candidacy in an election as a Member of the House of Representatives, yet having given written consent for a political party to submit their names as candidates for election under the party-list system, pursuant to Section 151 of the Organic Act on the Election of Members of the House of Representatives, B.E. 2561 (2018), and its amendment, as proposed by the Office of the Election Commission of Thailand.

          Section 151 provides that a person who commits such an offence shall be liable to imprisonment for a term of 1-10 years and a fine of 20,000 – 200,000 Baht, and the court shall order revocation of such person’s right to vote for a term of 20 years.
